General Terms and Conditions of Sale to Consumers

A note to our international customers

We understand that Terms and Conditions are not the most enjoyable part of an online purchase. However, they are essential to clearly define the rules governing the contractual relationship between you and Cicli Corsa Srl.

These Terms and Conditions must be accepted for each purchase made on ciclicorsa.com. For this reason, we have structured them in a clear and orderly way and strongly encourage you to read each section carefully before placing an order.

This document is intended to define the legal framework of the purchase. It does not aim to explain every practical aspect of the buying experience in detail.

Cicli Corsa has always aimed to build a direct, transparent and fair relationship with its customers. These Terms define the contractual rules, while our customer service and informational content reflect how we work every day: with care, availability and common sense.

If you have any questions or special situations, we invite you to contact us. Beyond written terms, we believe in dialogue and reasonable solutions, consistent with the value of the products we sell and the trust placed in us.

1. Seller and scope of application

These Terms and Conditions govern the sale of Products and the provision of Services by Cicli Corsa Srl, an Italian company with registered office at Via Privata Lorenzi 16, 24126 Bergamo (BG), Italy, through the website ciclicorsa.com.

They apply exclusively to consumers, defined as natural persons purchasing for purposes unrelated to any business, professional or commercial activity.

Any other terms or conditions are excluded unless expressly agreed in writing by Cicli Corsa Srl.

2. Applicable law and jurisdiction

All contracts concluded through ciclicorsa.com are governed by Italian law.

Any dispute arising from or related to these Terms, the Products or the Services shall fall under the exclusive jurisdiction of the Court of Bergamo (Italy).

The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

3. Orders and contract conclusion

Each order submitted by the Customer constitutes a binding offer to purchase under these Terms.

The contract is deemed concluded only upon issuance of a written Order Confirmation by Cicli Corsa Srl.
If the Order Confirmation is not contested within 7 days, it shall be considered accepted.

Cicli Corsa Srl assumes no responsibility for losses or damages arising from business, professional or commercial use of the Products by the Customer or third parties.

4. Quotations and product modifications

Any quotation issued by Cicli Corsa Srl is valid for 10 days, unless otherwise stated in writing.

Cicli Corsa Srl reserves the right to make changes to Products or Services, provided that equivalent functionality is guaranteed and the Customer gives written acceptance.

5. Prices and payments

All prices indicated in the Order Confirmation and invoice must be paid in full prior to shipment or service execution.

Cicli Corsa Srl reserves the right to suspend delivery or performance until full payment has been received.

Prices include Italian VAT where applicable, unless otherwise specified.

6. Shipping, delivery and inspection

Delivery dates are indicative only.

In the event that a Product or Service becomes unavailable, Cicli Corsa Srl will inform the Customer within 30 days from the day following the order and, upon request, will refund any amounts already paid.

Upon delivery, the Customer is required to verify that:

• the number of packages corresponds to the transport documents, and

• the packaging is intact and shows no visible signs of damage.

Any damage, missing items or anomalies must be reported within 48 hours of delivery by email to customerservice@ciclicorsa.com, including photographic evidence where possible.

If the packaging appears damaged or tampered with, the Customer must accept the delivery with reservation, noting this to the courier and informing Cicli Corsa Srl promptly.

Acceptance of the shipment without reservation prevents any claim against the carrier for transport-related damages or losses.

Cicli Corsa Srl is not responsible for delays or non-delivery caused by force majeure or events beyond its reasonable control.

7. Transfer of ownership and risk

Ownership of the Products passes to the Customer only upon full payment.

The risk of loss or damage passes to the Customer at the time of delivery.

8. Right of withdrawal (EU framework)

Under applicable EU consumer protection laws, Customers may have a right to withdraw from a purchase within a limited period, subject to specific conditions.

The right of withdrawal must be exercised within 10 working days from contract execution by written notice sent via email.

The right of withdrawal is void if the Product has been used, installed, mounted or altered in any way that makes it unsuitable for resale.

Returned Products must be sent back within 30 days from the withdrawal notice, in perfect condition, as new, and in their original packaging.

Refunds will be issued within 30 days, net of return shipping costs and any deductions for damages or loss of value.

9. Customs duties, taxes and international shipments

For shipments outside the European Union, customs duties, import taxes, local VAT and clearance fees may apply.

Such charges are entirely the responsibility of the Customer and are not included in the purchase price or shipping costs.

Delays caused by customs clearance procedures are beyond the control of Cicli Corsa Srl and do not constitute grounds for cancellation or compensation.

10. Privacy and data protection

Personal data is processed in accordance with applicable data protection laws and the Cicli Corsa Privacy Policy, available on ciclicorsa.com.

Data may be shared with third parties involved in order fulfillment, always in compliance with data protection requirements.

11. Intellectual property

All intellectual property rights related to the Products and Services remain the property of Cicli Corsa Srl or their respective owners.

The Customer agrees to notify Cicli Corsa Srl of any unauthorized use or infringement.

12. Legal warranty and manufacturer warranty

Products sold by Cicli Corsa Srl are covered by the mandatory EU legal warranty of conformity, where applicable.

Any manufacturer’s commercial warranty is additional and does not replace the legal warranty.

The warranty does not cover defects caused by improper use, negligence, unauthorized modifications or normal wear and tear.

Replaced components remain the property of Cicli Corsa Srl and must be returned upon request.

13. Services

Cicli Corsa Srl warrants that Services will be performed in accordance with their description and with reasonable skill and care.

14. Assignment and subcontracting

The contract is personal and may not be assigned by the Customer without written consent.

Cicli Corsa Srl may assign or subcontract the contract for organizational or commercial reasons, ensuring equivalent reliability.

15. Limitation of liability

To the maximum extent permitted by law, Cicli Corsa Srl shall only be liable for direct and foreseeable damages arising from its breach of contractual obligations.

No liability is accepted for indirect, consequential or unforeseeable losses.

16. Force majeure

Cicli Corsa Srl shall not be liable for delays or failure to perform caused by events beyond its reasonable control, including but not limited to natural disasters, strikes, supply chain disruptions or governmental actions.

17. Reference documentation

Product descriptions, Service descriptions and the Privacy Policy are available on ciclicorsa.com and form an integral part of these Terms.

18. Mandatory consumer protection rules

Nothing in these Terms affects mandatory consumer protection provisions that cannot be waived under applicable law.

19. Prevailing language

In the event of discrepancies between language versions, the Italian version of these Terms and Conditions shall prevail.
